Nova Scotia Health is denying any negligence related to the death of a woman in an Amherst ER.
Allison Holthoff’s family filed a lawsuit last month claiming the hospital neglected to meet a standard of care.
The 37-year-old died after a lengthy emergency room wait at the Cumberland Regional Hospital on New Year’s Eve.
According to court documents obtained by Global News, NSH filed a notice of defiance on February 28, claiming the hospital’s standard of care was reasonable, considering circumstances.
They deny one section of the lawsuit in particular, where it says they failed to test her in a timely manner, triage her properly as well as rule out any possible diagnosis that posed a serious risk.
Nova Scotia Health is asking for the lawsuit to be dismissed.
A review of the situation was conducted follow Holthoff’s death.
The allegations in the lawsuit have not been proven in court.
